Q. Could the scope of section 60 of the Health Act 1999 be extended in the future to include functions other than regulation?

A. Yes: however:

  • Changes to the scope of section 60 require changes to primary legislation and are subject to extensive consultation and full Parliamentary scrutiny.
  • There are currently no plans to seek to extend the scope of section 60 of the Health Act 1999 in respect of pharmacy beyond that set out in the Health and Social Care Act 2008.

Q. Why is the scope of section 60 being extended to the Medicines Act 1968 and the Poisons Act 1972?

A. As well as regulating individual practitioners, the RPSGB has powers under the Medicines Act 1968 and Poisons Act 1972. For the RPSGB this includes the registration of pharmacy premises in Great Britain and the enforcement of provisions within medicines and poisons legislation. The scope of section 60 has been extended to cover these provisions in the Medicines Act 1968 and Poisons Act 1972 so that all the statutory functions of the RPSGB can be transferred as a package to the new GPhC.
